Legal Elite – Bankruptcy 2015

BANKRUPTCY WINNER

James S. "Charlie" Livermon III
Poyner Spruill LLP, Rocky Mount

During my third year in law school, I noticed a job posting for an associate position in the bankruptcy and creditor’s rights section of a firm that was vaguely familiar to me. What was more familiar was the name of the person with whom I would interview. Prior to his senior year in college, this person worked as an intern at my father’s law firm. One of his duties that summer was to drive me around the state to junior tennis tournaments. During the interview, I confessed that I knew nothing about bankruptcy and that I sent in my resumé because I recognized his name. According to him, that was a good thing because he did not have to break me of any bad habits. Fortunately, I got the job, and I have been with Poyner Spruill ever since. The interviewer was the honorable David M. Warren, bankruptcy judge for the Eastern District of North Carolina.

Vita: 45; born in Rocky Mount; bachelor’s from Hampden-Sydney College and law degree from Campbell University; wife and two children.

Memorable case: I represented a creditor in a bankruptcy case involving a failed real-estate development in South Carolina. My client, an individual who provided $15 million in seller financing, took me on a tour of the development, and around every turn there was a dead alligator. Apparently the development had an alligator problem. Other challenges were that most of the lots in the subdivision were foreclosed for unpaid property taxes, the developer had sold my client’s swimming pool and back porch to a speculator, and there was an alleged documentation defect that could have invalidated the $15 million mortgage. All worked out in the end, except for the alligators.

Favorite place: Shark Island, off the tip of Cape Lookout.

Hero: My father, the hardest-working person I know and who always manages to have a smile on his face.
